The scope of the areas affected by the quake mainly included the north-east China along the Longmen Shan fault. The Sichuan Basin was created 55 millions years ago, where the Indo-Australian Plate collided with the Eurasian Plate. These endogenetic forces create fold mountains, and therefore the Sichuan basin is bounded by mountains on all sides. As a consequence, areas around the Sichuan Basin are prone to earthquake. To be precise, according to the United States Geological Survey, the earthquake occurred because of the motion on a northeast striking reverse fault on the northwestern edge of the Sichuan Basin. Since the crustal materials moved slowly from the high Tibetan Plateau, when they flowed to the strong crust underlying the Sichuan Basin and southeastern China, pressure gradually developed. The energy was then released in the form of seismic waves and thus led to the occurrence of the earthquake. Another possible cause is that the huge amount of water storage in reservoirs in Sichuan developed stress over the crust. The pressure stored may be released, causing an earthquake. There were not any official warnings prior to the main quake. This is attributed to the fact that earthquakes are hard to forecast, and the results are not always accurate. However, it is said that there was a sign revealing the earthquake: a large number of toads were migrating in Sichuan two days before the main quake. These animalsââ¬â¢ abnormal acts may reflect in earthquake events. In the Sichuan Earthquake, the China Earthquake Administration did not find strong evidence to show that an earthquake was to be occurred. Therefore, when the earthquake came, evacuation could not be made effective and thus a huge damage was resulted. Then on 12 May, an earthquake indeed struck the area. The main quake of the Sichuan Earthquake took place at 14:28 local time, nevertheless, the rupture lasted for only 120 seconds. In the following three days, many aftershocks still threatened the people. There were 64 to 104 major aftershocks, with magnitude ranging from 4. 0 to 6. 1. These aftershocks continued to bring new deaths and casualties in the area. For example, on 17 May, an aftershock destabilized a slope and caused a landslide. On 25 and 27 May, the Qingchuan County had two aftershocks on the spot with magnitudes greater than 5. On 27 May again, an aftershock hit the Ningciang County. Till 29 June, the number of deaths has reached about 70,000 and over 370,000 people were injured. More than 17,000 people were missing, and many people were made homeless. More than 15 million people must be evacuated out of the area, and about 45 million people were affected by the incident. As a recent natural hazard, the Sichuan Earthquake is definitely a severe one, with a tremendous destruction. This earthquake caused the most serious casualties and deaths after the occurrence of the Tangshan Earthquake in 1976. Apart from the loss of lives, the earthquake brought about many impacts as well. The impacts can be divided into three aspects, namely social, economic, and environmental. First, 0. 21 million of buildings and houses were collapsed, including 7,000 schools. On the other hand, the Sichuan Earthquake brought environmental issues. In the affected areas, clean water was inadequate. When people had to drink contaminated water, illnesses or diseases may be developed. Also, in the areas, corpses were everywhere and we know how unhygienic it was! Together with the warm temperature, the filthy place set up a good condition for diseases to spread. To make the affected areas more hygienic, the death bodies must be incinerated, and cleaning agents like insecticides must be sprayed regularly. Meanwhile, the affected areas were heavily polluted. The earthquake initiated poisonous gas leakage, explosions or fires, which in turn polluted the air. The ecology was disrupted as well. On the economic aspect, the disastrous events led to huge economic losses. The government used more than $400 billion for relief and rescue work. The Shanghai Stock Exchange and Shenzhen Stock Exchange lost connection with Sichuan and Chengdu companies, the companiesââ¬â¢ stock prices dropped substantially afterwards. Owing to fact that the earthquake has destroyed Sichuan so terribly, prompt relief and rescue work was crucial. The mitigation work involved the efforts of local government, regional and international aid. The central government sent different leaders to the affected areas to manage relief work. Australia is split into different states and territories that have their own government. These territories include the Australian Capital Territory, New South Wales, the Northern Territory, Queensland, South Australia, Tasmania, Victoria, and Western Australia. This is important to note because each individual state government manages the schools within its territory (Immi.Gov). They provide both the regulations and funding to both the public and private schools, though the government only provides the public schooling and private schools are offered by Churches and other groups (Immi.Gov). Some of the biggest differences between our US School system and the Australian system is how the school operates on the inside. Most of the schools throughout Australia enforce either a uniform code or a dress code, and most attendees bring their own lunches to school, although food can be purchased at the canteen - or cafeteria, in our terms (Working-In Australia.com). According to my friend Graham, the in school hours are generally the same as hours, starting at 8 AM and ending at 3 PM. The school term for Australia is also very different from our own. A 200 gm sample of gypsum is prepared, and put over a plate, to be added with a specified amount of water. 2. The gypsum is mixed thoroughly with water for 3 minutes, to form a moist paste. 3. A part of the paste is poured in the Vicat's mold, until the mold is filled completely with the paste and the surface of the mold is rimmed. 4. Vicat's mold is applied on the base of Vicat's device. The pointer of the device is adjusted to just touch the surface of the mold, then left to fall freely under the influence of its weight. . The reading of Vicat's pointer is taken. This reading indicates the depth that the pointer has reached above the base of the mold. 6. The experiment is repeated using a new sample each time; until the standard water content is reached (Vicat's needle would reach a height of (30-32) mm above the base of the mold. â⬠¢ Determination of the setting time for gypsum: 1. A 200 gm sample of gypsum is prepared. The amount of water determined in the previous experiment is added to the sample. 2.The gypsum is mixed thoroughly with water for 3 minutes, to form a moist paste, and then part of the paste is poured in the Vicat's mold, until the mold is filled completely with the paste and the surface of the mold is rimmed. 3. 504 Plans for Students with Dyslexia
Some students with dyslexia are eligible for accommodations in school under Section 504 of the Rehabilitation Act. This is a civil rights law prohibiting discrimination based on a disability in any agency or institution which receives federal funds, including public schools. According to the U.S. Office for Civil Rights, students are eligible for accommodations and services, as needed, under Section 504 if they (1) have a physical or mental impairment that substantially limits one or more major life activities; or (2) have a record of such an impairment; or (3) be regarded as having such an impairment. A major life activity is one that an average person can complete with little or no difficulty. Learning, reading, and writing are considered major life activities. Developing a Section 504 Plan If parents believe their child needs a 504 plan, they must make a written request to ask the school to evaluate a child for eligibility for accommodations under Section 504. But teachers, administrators and other school personnel can also request an evaluation. Teachers might request an evaluation if they see a student having chronic problems in school and they believe these problems are caused by a disability. Once this request is received, the Child Study Team, which includes the teacher, the parents and other school personnel, meets to decide if the child is eligible for accommodations. During the evaluation, the team reviews recent report cards and grades, standardized test scores, discipline reports and talks with parents and teachers about school performance. If a child has been privately evaluated for dyslexia, this report will probably be included. If the student has other conditions, such as ADHD, a doctors report may have been submitted. The educational team reviews all of this information to decide if a student is eligible for accommodations under Section 504. If eligible, the team members will also offer suggestions for accommodations based on the individual needs of the student. They will also outline who, within the school, is responsible for implementing each of the services. Usually, there is an annual review to determine if the student is still eligible and to review the accommodations and see if changes need to be made. The General Education Teachers Role As the teacher, general educators should be involved in the evaluation process. During the evaluation, teachers are in a position to offer an insider view of the daily problems a student is having. This may mean completing a questionnaire to be reviewed by the team, or you may elect to attend the meetings. Some school districts encourage teachers to be in the meetings, giving their perspective and offering suggestions for accommodations. Because teachers are often the first line in implementing classroom accommodations, it makes sense for you to attend meetings so you better understand what is expected and you can voice objections if you feel an accommodation would be too disruptive for the rest of your class or too difficult to carry out. Once the Section 504 has been developed and accepted by the parents and the school, it is a legal contract. The school is responsible for making sure all aspects of the agreement are carried out. Teachers do not have the ability to decline or refuse to implement accommodations listed in the Section 504. They cannot pick and choose which accommodations they want to follow. If, after the Section 504 has been approved, you find that certain accommodations are not working in the students best interest or interfere with your ability to teach your class, you must talk with your schools 504 Coordinator and request a meeting with the educational team. Only this team can make changes to the Section 504 Plan. You may also want to attend the annual review. Usually Section 504 plans are reviewed on an annual basis. During this meeting the educational team will decide whether the student is still eligible and if so, whether the previous accommodations should be continued. The team will look to the teacher to provide information about whether the student utilized the accommodations and whether these accommodations helped the student within the classroom. The person has resided constantly or in discontinuity for more than half year of income in Australian territorial frontiers The person must be a member of the scheme of superannuation By taking this given situation into account, during Financial Year 2015-16, Jenny did not meet the criteria of the provided statutory tests. She resided there for the tenure of 65 days (4 (April) + 31 (May) + 30 (June) in the specified financial year that will be less than half a year. Moreover, she neither met these three criteria that are no permanent resident in Australia, not enclosed under usual meaning of resident provided in subsection 6(1) of the ICAA 1936 and nor a member of the scheme of superannuation. Thus, she is not considered as an Australian tax resident in the FY 2015-16, however in the financial year 2016-17. However, she resided in the Australian political boundaries for more than half of the FY, so he is eligible to have title of tax resident in 2016-17. Although; in case the tax commissioner of income gives the judgment that permanent residence of Jenny outside of Australia then she will be considered as a non-tax resident. Common law criteria have not been satisfied by Jenny as the main circumstances are not met by her. As per statutory test in the Financial Year 2015-16, Jenny will not be considered as a tax resident of Australia, but she is said to be a tax resident in Financial Year 2016-17 as she has satisfied the statutory tests required to be tax resident, that is she resided in Australia for more than half financial year. However, if the Income Tax Commissioner believed that Jenny has a permanent resident outside of Australia than by his judgment he can keep Jenny out of Bracket of Tax Residency. The case addressed a well-known personality who was paid a lump sum amount of $400,000 for joining the new television network. The addressed person accepted to work with the new network with a monthly remuneration of $100,000 along with the lump sum payment. It is to be determined that whether this two income will form a part of Assessable income as per the tax provisions provided by the Australian Standards. The major problem which arises in the determination of assessable income as per ATP (Australian taxation provisions), is the classification of activities that can be categorized under assessable income. Thus the provisions that can be applied to this case are the provision of ordinary income [Section 6 (5)] of ITAA97. This also includes any other part of capital receipts given under the right to Income. Thus, as per the above-mentioned provisions, assesable income includes all the taxable income; the income under ordinary concept is also included in the same. Although the provision does not provide any description of income under the ordinary concept, however, it is considered to be the income which is earned by people that can be normally recognized as assessable income by the concept of common laws income. In a famous case in this regard- FCT v Woit, it was found that a payment received by a person for signing a contract for not playing football for any other team other than in whi ch the person was currently playing, was not considered as an assessable income. However, as per Woites case, the payment will be considered under capital, if the purpose is to provide the right to earn income (Woellner and et.al. 2011). Ultimately, it seems that the payment was an incentive made to the taxpayer for entering into an agreement. Thus it makes the payment as an ordinary income provided for the purpose of rendering service in exchange of $400000. As per Section 6(5), it is the ordinary income since it is made to them for performing some service and by the agreement, no significant rights were being provided by the taxpayer. Moreover, according to section 15(2) [ITAA 1997], the taxpayers taxable income includes all gratitude, benefit, grants and compensation which is received by them in association with their employment or any services provided by them but it excludes ordinary income. The income which is not to be considered under the assessable income includes the following: Hobby earnings inheritance gifts Prizes and awards received by the taxpayer that are not directly or indirectly related to business (Shields North-Samardzic, 2015). unless the taxpayer operates a business of betting or gambling, the wins form that betting and gambling cannot be included in assessable income. GST (goods and services tax) collected by the taxpayer. Borrowed money Case and their associated laws relevant to the above situation An incentive scheme was purposely initiated by Westpac for their employees for carrying out research and study regarding the operations they conducted in the organization. The research was to be paid by the company after finishing their respective course. Improvement of the qualified expertise staff was the main aim of the scheme (Tran-Nam, 2016). The verdict of the case in this act was that this income would be considered as assessable income under ITAA 1936, Section 26(e) and under the Section 15(2) (Faccio Xu, 2015). The justification of the court in this regard was that this income was not a part of their personal gift and also not ordinary income; moreover, this scheme was designed by the company for improving performance and efficiency of the workers. Hence, this was to be considered as an income from their employment. However; the receipt of AUD400000 is not clarified; thus when compared to the case of White and Jarrold v Boustead [1]and the Brent vs FCT[2], then it will be considered as ordinary income as the payment can be directly associated with provision of services. As per section 15(2), it will be reliable to not consider the amount of $400,000, as ordinary income and there are an adequate amount of facts of the same. Thus, the payment of $400,000 received by the taxpayer will be considered as statutory income in accordance the above-mentioned section, because they comprise benefits given in regards to services. A recommendation is provided Under Smith v FCT (1987) 19 ATR 274 that the conduct of nexus test will make it easier to meet terms according to section 15(2), as against those mentioned in Section 6(5). The assumption that the payment is an incentive for employment agreement will disclose it as arising out of future services.
